Terms of Service

These Terms of Service (“Terms”) constitute a legally binding agreement between you (“User,” “you,” or “your”) and AICord (“AICord,” “we,” “us,” or “our”), governing your access to and use of the AICord software, bot, services, and related offerings (collectively, the “Service”).

By installing, inviting, accessing, or otherwise using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree, you must not access or use the Service.


1. Eligibility and Acceptance

1.1. The Service is intended solely for individuals who are at least thirteen (13) years of age or the minimum age of digital consent in their jurisdiction or have parental consent to use the Service. By using the Service, you represent and warrant that you meet these requirements.

1.2. If you are accessing or using the Service on behalf of a legal entity, you hereby represent and warrant that you are authorized to bind such entity to these Terms, and all references herein to “you” and “your” shall apply to both the individual user and the entity.


2. Description of Service

2.1. AICord is an AI-powered software platform integrated with Discord, providing chatbot characters, roleplay interactions, and related services.

2.2. AICord reserves the right, in its sole discretion and without obligation to provide notice, to modify, suspend, or discontinue any aspect of the Service, including but not limited to functionality, features, and availability.


3. Accounts and Access

3.1. You are solely responsible for all activities conducted under your Discord account in connection with the Service.

3.2. You agree to comply at all times with the Discord Terms of Service, all applicable laws and regulations, and these Terms.

3.3. AICord may, in its sole discretion and without liability, restrict, suspend, or terminate your access to the Service, with or without notice, for any reason or no reason, including without limitation any actual or suspected violation of these Terms.


4. Prohibited and Illegal Content

4.1. You shall not use the Service to create, generate, share, transmit, or promote content that is illegal, infringing, or otherwise prohibited, including but not limited to: (a) child sexual abuse material (“CSAM”); (b) content that incites violence, terrorism, or criminal activity; (c) content infringing any intellectual property or privacy rights; (d) fraudulent, misleading, or defamatory content; or (e) malware, spam, scams, or other malicious activity.

4.2. AICord reserves the right, but not the obligation, to monitor, remove, block, or report content at its sole discretion, and may cooperate with legal authorities and platform providers.


5. NSFW Content and Age Restrictions

5.1. Certain characters and features of the Service may be designated as “not safe for work” (“NSFW”). Such content is strictly limited to Users who are at least eighteen (18) years of age.

5.2. NSFW content must not be made visible, accessible, or otherwise provided to minors under any circumstances.

5.3. By accessing NSFW features, you represent and warrant that you are at least eighteen (18) years old. Any misrepresentation shall constitute a material breach of these Terms.


6. Harmful Conduct

6.1. You shall not use the Service to harass, abuse, defame, threaten, exploit, or otherwise cause harm to any individual or group.

6.2. You shall not use the Service to encourage, glorify, or promote self-harm, suicide, or physical harm to others.

6.3. The Service is not designed to provide medical, psychological, legal, financial, or other professional advice, and should not be relied upon as such. If you or any person is in crisis, you must seek immediate professional assistance.


7. Content and AI Interactions

7.1. The Service uses artificial intelligence models to generate content. Such content may be inaccurate, offensive, or unintended.

7.2. All outputs are provided for entertainment and simulation purposes only. You acknowledge that no AI-generated content constitutes advice or factual information and that reliance upon such content is at your sole risk.

7.3. You remain solely responsible for any content you input, create, or disseminate through the Service.


8. Paid Plans, Billing, and Refunds

8.1. The Service may be offered on both free and paid subscription tiers. By subscribing, you authorize recurring charges until cancellation.

8.2. All fees are due in advance and are non-refundable, except as expressly set forth herein or where otherwise required by applicable law.

8.3. Refund Policy. Users may request a refund for the current billing month within thirty (30) days of purchase, provided that: (i) the Service has not been substantially used, and (ii) the User is unsatisfied. Refund eligibility shall be determined by AICord in its sole discretion.

8.4. AICord reserves the right to change subscription fees, billing methods, or features at any time with reasonable prior notice.

8.5 Any attempt to dispute, reverse, or charge back payments to AICord through your bank, payment processor, or other financial institution will result in immediate termination or suspension of your account and access to the Service. AICord reserves the right to contest such disputes with evidence of usage, subscription, or transactions to challenge such disputes, and you shall remain liable for all undisputed amounts plus any associated costs.


9. Data and Storage

9.1. The Service is not a data storage or archival solution. AICord makes no representation, warranty, or guarantee regarding the storage, retention, security, or recovery of any User data, content, or communications.

9.2. AICord may, at any time and without notice, delete, remove, modify, or restrict access to any data or content submitted through the Service.

9.3. Users are solely responsible for maintaining backups of any data they wish to preserve.


10. Intellectual Property

10.1. All rights, title, and interest in and to the Service, including but not limited to software, code, designs, trademarks, logos, and other intellectual property, are and shall remain the exclusive property of AICord and its founder, Peter Till.

10.2. Users retain ownership rights to content they submit, but hereby grant AICord a worldwide, royalty-free, non-exclusive, transferable, sublicensable license to process, store, reproduce, and use such content as necessary to provide and improve the Service.


11. Termination

11.1. AICord may, in its sole discretion, suspend, restrict, or terminate your access to the Service, or remove any associated data, at any time and without notice or liability, for any reason or no reason.

11.2. Upon termination, all rights granted to you under these Terms shall immediately cease. AICord shall have no obligation to refund fees (except as expressly provided in Section 8) or retain any User data following termination.

11.3. You may cease using the Service at any time by removing the bot or cancelling your subscription.


12. Disclaimer of Warranties

12.1. The Service is provided on an “AS IS” and “AS AVAILABLE” basis, without warranties of any kind, express or implied, including without limitation warranties of merchantability, fitness for a particular purpose, accuracy, non-infringement, or uninterrupted availability.

12.2. To the fullest extent permitted by law, AICord disclaims any and all responsibility for harm, loss, or damages arising from reliance on or use of the Service.


13. Limitation of Liability

13.1. To the maximum extent permitted by applicable law, in no event shall AICord, or its founder or team members individually, be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages, including without limitation lost profits, data, goodwill, or business opportunities, even if advised of the possibility of such damages.

13.2. In no event shall AICord’s total cumulative liability for any claims arising out of or relating to the Service exceed the amount actually paid by you to AICord in the three (3) months preceding the event giving rise to the claim.


14. Indemnification

You agree to indemnify, defend, and hold harmless AICord, including any affiliates, licensors, officers, directors, employees, or agents, from and against any and all claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys’ fees) arising out of or related to: (i) your use of the Service, (ii) your violation of these Terms, or (iii) your violation of any rights of any third party.


15. Governing Law and Dispute Resolution

15.1. These Terms shall be governed by and construed in accordance with the laws of Hungary, without regard to its conflict of law principles.

15.2. Any dispute, controversy, or claim arising out of or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts located in Hungary.

15.3. At AICord’s sole option, disputes may instead be submitted to final and binding arbitration, and judgment on the award rendered by the arbitrator(s) may be entered in any court having jurisdiction.


16. Changes to Terms

AICord reserves the right to modify or update these Terms at any time in its sole discretion. Such changes shall be effective immediately upon posting, unless otherwise specified. Your continued use of the Service following any changes constitutes acceptance of the revised Terms.
